Executive orders

Trump’s Executive Orders

Since his inauguration on January 20, 2025, President Trump has signed several executive orders that prioritize common sense in education. He’s also rolled back misguided orders from former President Biden that hindered educational progress.

As the head of the Executive Branch, the Constitution vests the President of the United States with the duty to enforce the country’s laws. Executive orders are directives from the president to executive branch officials to help manage federal operations. These orders establish a framework for carrying out the president’s policies and have the power of law.

While the effects of executive orders may not always be immediate, this resource provides a clear look at what they mean, their potential consequences, and how educators should respond.

1. What Is The Focus Of These Executive Actions?

President Trump’s recent Executive Orders address two key priorities. First, they restore a traditional understanding of biological sex, ensuring that girls do not have to share sex-separated spaces and activities with biological boys. These orders reverse ideological attempts by the prior administration to eradicate the biological reality of sex.

Second, they aim to end the radical indoctrination of critical race theory and similar harmful ideologies in K-12 education. The Orders reject the idea of assigning moral value based on immutable traits like sex, nationality, race, or ethnicity, instead promoting American values and reinforcing the crucial role of parents in their children’s education.

2. President Trump’s Executive Order 14168: “Defending Women From Gender Ideology Extremism And Restoring Biological Truth To the Federal Government”

This Order establishes federal policy to reaffirm the understanding of biological sex as an immutable classification of male or female.

This means that when applying a statute, regulation, or guidance, sex-related terms should be construed in accordance with biological sex. The Executive Order also prohibits the use of federal funds to promote gender ideology and encourages K-12 schools to comply, with the threat of losing federal funding for non-compliance. Additionally, agencies are directed to ensure that intimate spaces—like bathrooms and locker rooms—are designated based on biological sex, not gender identity.

While the exact impact on K-12 schools remains uncertain, the Order calls for federal agencies to develop plans for further implementation. The Order signals an intent to ensure that gender-based bathrooms, locker rooms, and other intimate spaces are limited by biological sex.

3. President Trump’s Executive Order 14151: “Ending Radical Indoctrination In K-12 Schooling”

This Order aims to reverse policies that promote anti-American ideologies in schools and limit parental involvement. It seeks to prevent the teaching of “discriminatory equity ideology,” which treats individuals as members of favored or unfavored groups instead of as individuals, undermining merit, agency, and capability in favor of harmful generalizations. The Order calls for a focus on patriotic education that emphasizes America’s core principles in a unifying, inspiring, and dignified way.

The Order directs executive officers and agencies to develop a strategy for implementation, which may include cutting federal funding for non-compliant institutions, strengthening enforcement of parental rights, and taking action against teachers or school officials who violate laws.

4. President Trump’s Executive Order 14201: “Keeping Men Out Of Women’s Sports”

This Order aims to prevent biological males from competing in women’s sports, highlighting the unfair, demeaning, and dangerous consequences of allowing such participation. It establishes a clear policy that federal funds will be withheld from educational programs that undermine fair athletic opportunities for women and girls, specifically opposing male involvement in female sports.

The Order directs Title IX enforcement actions against institutions that force female athletes to compete against or undress in front of males, denying them equal opportunities.

5. How These Orders Are Implemented and Enforced

These Orders do not provide a private cause of action, meaning they do not grant teachers or students the right to sue an institution for failing to comply with the policies. However, they do not prevent individuals from pursuing legal action based on violations of state or federal laws, constitutions, statutes, or existing causes of action.

Instead, the Orders outline a framework for executive agencies and officials to enforce the policies through other means. For example, they allow for federal funding to be withheld from non-compliant institutions. Additionally, the Orders set broad goals and directives, tasking executive agencies with creating procedures to implement these objectives effectively.

6. What Are The Practical, On The Ground, Effects That These Orders Will Have?

Educational institutions should take proactive steps to ensure compliance with the relevant Executive Orders. This includes reviewing the school’s curriculum, training programs, services, and policies related to athletics and intimate spaces. Schools should also assess their policies on handling gender non-conforming students, particularly regarding parental notification, counseling, and identity-based activities. Additionally, schools should review their policies on parental disclosures.

Many state laws and school policies conflict with these federal Executive Orders, and lawsuits are currently pending that address the issues raised by these Orders. As the Orders are implemented, more legal challenges are expected. The outcomes of these cases will help clarify any conflicts between the Orders and existing laws.

** As the landscape of education continues to evolve in response to President Trump’s Executive Orders, it is crucial for educational institutions to stay informed and take necessary steps to ensure compliance. The impact of these Orders will likely continue to unfold, with legal challenges playing a significant role in shaping their implementation.
